1. Eligibility. NO PURCHASE NECESSARY. The �Paramore/Cute Is What We Aim For� Flyaway Sweepstakes (the "Sweepstakes") is open and offered only to legal U.S. residents age 18 or older as of July 9, 2007, who at the time of entry reside in and are physically located in the 50 United States and the District of Columbia (excluding Rhode Island and U.S. territories and possessions). Excludes employees, directors, agents and/or affiliates of Hot Topic, Inc. (�Sponsor�), Fueled by Ramen (�FBR�), Atlantic Records (�Atlantic�) and Southwest Airlines (�SWA�) and their respective immediate family and household member, regardless of residence and whether or not related. By entering the Sweepstakes, you (or your parent/legal guardian if you are a minor in your jurisdiction of primary residence, on their and your behalf) agree to be bound by these terms and conditions. All decisions of Sponsor are final.

 

2. Entry: Sweepstakes begins at 12:01 a.m. (Pacific Time) on July 9, 2007 and ends at 11:59 p.m. (Pacific Time) on August 6, 2007 and will be conducted and administered at the sole discretion of Sponsor. Enter online at http://www.hottopic.com,'>http://www.hottopic.com, and provide full name, mailing address, date of birth, email address and telephone number(s). You may also enter by hand printing your full name, mailing address (with zip code), date of birth, and telephone number(s) on a 3.5" x 5" postcard mailed to: �Paramore/Cute Is What We Aim For Flyaway Sweepstakes�, c/o Hot Topic Marketing Dept., Hot Topic, Inc., 18305 E. San Jose Avenue, City of Industry, CA 91748. All online entries must be submitted by 11:59 p.m. (Pacific Time) on August 6, 2007. All mailed entries must be postmarked by August 6, 2007, and received no later than August 8, 2007. Limit one entry per person. Illegible, incomplete or mechanically reproduced entries will not be accepted. Sponsor is not responsible for late or misdirected online entries, computer problems, or internet communications. For purposes of this Sweepstakes, email addresses are deemed to belong to the individual whose name appears on the email account as owner. Sponsor is not responsible for late, lost, stolen, misdirected, mutilated or postage due mail. Any and all expenses incurred in connection with participation in the Sweepstakes are the sole responsibility of the participant. By participating in this Sweepstakes, participants elect to share contact information with Sponsor, FBR, Atlantic and SWA. Sponsor�s use of information will be in accordance with the Hot Topic, Inc. 3. Drawing/Odds: On or about August 9, 2007, Sponsor will randomly draw winners (�Winners�) from among all eligible entries submitted and received. Odds of winning depend on the number of eligible entries received. Winners will be notified by telephone and/or email (Sponsor reserves the right to determine notification method). Prize: Five (5) Winners will each receive a prize consisting solely of: Two (2) roundtrip coach class airfare tickets (with location, dates and time to be determined by Sponsor and FBR) for Winner and a guest; hotel accommodations of one (1) room for two (2) nights; $50 for transportation costs to and from the airport and concert venue; two (2) passes to the �Paramore/Cute Is What We Aim For� private performance (currently scheduled to take place on 8/18/07); and two (2) $25 Hot Topic gift cards (collectively the �Prize�). Total approximate value of each Prize: $1,200. Winners must claim Prize within two (2) business days of prize notification or an alternate winner may be selected. Winners will be solely responsible for any and all taxes in connection with the Prize and all other expenses and/or terms not specifically described as part of the Prize. If any Winner cannot accommodate travel as specified by Sponsor and/or FBR, or Prize or notification of Prize is returned as undeliverable, Winner will be disqualified. Prizes may not be transferred, redeemed for cash, or substituted by Winners.

 

4. General Conditions: By participating in the Sweepstakes, you, together with your heirs and assigns, release and forever hold harmless Sponsor, FBR, Atlantic and SWA, and their respective employees, directors, shareholders, agents and affiliates, of any liability whatsoever for any and all claims, costs, losses, or damages of any kind (including, without limitation, those related to personal injury, death, damage to property, infringement or proprietary rights, rights of publicity, privacy or defamation) arising out of or in connection with your or any third party's participation in the Sweepstakes and/or Sweepstakes-related activity including, but not limited to, the use or misuse of any Sweepstakes prize. By accepting a Prize, Winners grant Sponsor, FBR, Atlantic and SWA the right to use and publish winners� name, bio, portrait, picture, voice and likeness solely in connection with the Sweepstakes for trade, advertising and promotional purposes in any and all known media, in perpetuity, all without further compensation, notification, review or approval, unless prohibited by law. Winners must complete, execute and return an Affidavit of Eligibility, Liability Release, and where lawful, Publicity Release. Failure to return documents as specified herein will result in disqualification. The age of majority varies by state. If applicable, a Prize won by a minor may be awarded in the name of the minor's parent/legal guardian, as determined by Sponsor. If any Winners are deemed to be ineligible or cannot accept a Prize as stated, the Prize will be deemed forfeited and may be awarded to an alternate winner. If, for reasons beyond the Sponsor�s control Sweepstakes is not capable of running as planned, Sponsor reserves the right to cancel or modify Sweepstakes and/or any component thereof including travel without notice or liability. Sponsor reserves the right to disqualify any individual it finds to be tampering with the entry process, the operation of the Sweepstakes, or to be acting in violation of these terms and conditions, and may prosecute such individuals to the full extent of the law. Sponsor shall have the right to interpret and apply these terms and conditions to individual circumstances in its reasonable discretion. THE CALIFORNIA COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES, WHICH SHALL BE GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA (EXCLUDING CONFLICT OF LAWS PROVISIONS). VOID WHERE RESTRICTED OR PROHIBITED BY LAW.

 

5. Winners' List: Winners� name will be posted online at http://www.hottopic.com on or about August 11, 2007. For a list of winners, mail a self-addressed stamped envelope to: �Paramore/Cute Is What We Aim For� Flyaway Sweepstakes Winners' List, c/o Hot Topic Marketing Department, Hot Topic, Inc., 18305 E.
